This Distance Sales Agreement (“Agreement”) is concluded between the SELLER whose information is provided below and the BUYER who places an order electronically through the website www.moddamarkt.com (“WEBSITE”), under the terms and conditions set forth herein.

By accepting this Agreement, the BUYER acknowledges, declares, and undertakes that if they approve the order subject to the contract, they will be obliged to pay the price of the product(s) subject to the order and, if any, shipping fees, taxes, and other additional fees explicitly stated before the order, and that they have been informed about this before the order.
2. DEFINITIONS
In the application and interpretation of this Agreement, the following terms shall have the meanings specified opposite them:

REGULATION: Regulation on Distance Contracts,
SERVICE: Any consumer transaction other than the provision of goods, performed or promised to be performed for a fee or benefit,
SELLER: A natural or legal person who offers goods to the consumer within the scope of their commercial or professional activities, or acts on behalf or account of the person offering the goods; for the purpose of this Agreement, Yasin Devge / Moddamarkt,
BUYER/CONSUMER: A natural or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes,
WEBSITE: The website www.moddamarkt.com belonging to the SELLER,
ORDERER: A natural or legal person who requests a good or service through the SELLER's website,
PARTIES: The SELLER and the BUYER,
AGREEMENT: This Distance Sales Agreement concluded electronically between the SELLER and the BUYER,
GOODS/PRODUCT: Movable property subject to trade and other products considered as goods within the scope of current legislation.
3. SUBJECT
The subject of this Agreement is to determine the rights and obligations of the PARTIES in accordance with the provisions of the relevant current legislation, especially the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts, regarding the sale and delivery of the product(s) whose basic characteristics and sales price are specified on the WEBSITE and during the order, which the BUYER ordered electronically through the SELLER's website www.moddamarkt.com.
The prices listed and advertised on the WEBSITE are sales prices. Advertised prices are valid until they are updated or changed. Campaign or discounted prices advertised for a specific period are valid until the end of the specified period.
Before completing the order, the BUYER is informed about the basic characteristics of the product, the total sales price, payment method, delivery conditions, shipping fee if any, right of withdrawal, and other necessary preliminary information.

The BUYER's information consists of the information declared by the BUYER on the WEBSITE during order creation.
The BUYER agrees that the information provided through the WEBSITE is accurate, current, and complete.

If the person placing the order and the person to whom the product will be delivered are different, the information provided on the WEBSITE during the order will be taken as a basis.
7. AGREEMENT SUBJECT PRODUCT/PRODUCTS INFORMATION
7.1. Basic Features
The basic characteristics of the good, product, or products subject to the Agreement; including the type, quantity, brand/model, color, size, number, material, and other distinguishing features if any, are published on the relevant product page of the SELLER's website www.moddamarkt.com.
Before completing the order, the BUYER can examine the basic characteristics of the product(s) they will purchase on the relevant product page.
If the SELLER organizes a campaign, the features, prices, and campaign conditions of the products included in the campaign can be examined on the WEBSITE during the relevant campaign period.
Product images are used to display the products as accurately as possible. Minor differences in color or appearance of the products may occur due to screen settings, lighting conditions, or production. This provision does not remove the consumer's legal rights regarding defective or non-conforming goods.
7.2. Prices
The prices listed and advertised on the WEBSITE are the sales prices of the products.
Advertised prices are valid until they are updated or changed. Campaign prices advertised for a limited time are valid until the end of the specified campaign period.
The product price applicable to the BUYER's order is the sales price shown to the BUYER on the WEBSITE at the time of order creation and approved by the BUYER.
7.3. Taxes, Shipping, and Payment Information
The sales price of the product(s) subject to the Agreement, including all taxes, product quantity, discounts if any, shipping/delivery fee, and the total amount to be paid by the BUYER, are shown to the BUYER on the WEBSITE before the order is completed.
Order information is determined as follows:
Product Description: Product(s) selected by the BUYER during the order
Quantity: Quantity selected during the order
Unit Price: Sales price shown during the order
Subtotal: Amount calculated during the order
Discount: Discount applied during the order, if any
Shipping/Delivery Amount: Amount shown to the BUYER during the order
Taxes: Amount shown if applicable during the order
Total: Final order amount shown to the BUYER on the order confirmation screen
Before confirming the order, the BUYER sees the total sales price and other fees to be collected from them and then proceeds with the payment.
Payment is made using one of the payment methods offered to the BUYER on the WEBSITE during the order.
For international shipments, customs duties, import taxes, VAT, customs processing fees, or similar additional charges may arise according to the legislation of the destination country. The responsibility for these fees is determined in accordance with the current legislation and the information provided to the BUYER before the order.

The invoice is prepared in accordance with the current legislation and the SELLER's invoicing method and is sent to the BUYER physically and/or electronically.
9. GENERAL PROVISIONS
9.1. Information and Acceptance
The BUYER acknowledges, declares, and undertakes that they have read and understood the basic characteristics, sales price, payment method, delivery conditions, shipping fee if any, right of withdrawal, return conditions, and information about the SELLER regarding the product(s) subject to the contract on the SELLER's WEBSITE and have given the necessary electronic confirmation.
The BUYER's electronic approval of the order means that they accept the provisions of this Agreement and the preliminary information provided to them before the order.
The BUYER is responsible for the accuracy and completeness of the delivery, communication, and invoice information provided during the order.
9.2. Delivery Time and Delivery
The product(s) subject to the contract are delivered to the delivery address provided by the BUYER during the order or to the person/organization designated by the BUYER for delivery.
Each product subject to the contract is delivered within the period specified before the order or on the WEBSITE, taking into account the distance of the BUYER's residence, the preparation time of the product, and shipping and logistics conditions, provided that it does not exceed the legal period of 30 days. IdeaSoft's sample contract also clearly states this 30-day legal upper limit for delivery.
If it is agreed that the product will be delivered to a person or organization other than the BUYER and the said person or organization does not accept the delivery, the consequences arising from this situation will be evaluated within the framework of the concrete case and the current legislation.
If delivery cannot be made or is delayed due to the BUYER providing incomplete or incorrect delivery information, the BUYER may be contacted.
If it becomes impossible for the SELLER to supply the product(s) subject to the order, the BUYER will be informed in accordance with the current legislation, and the collected amounts will be refunded to the BUYER within the period stipulated by the legislation.
International shipments may be sent from the SELLER's contracted supplier, warehouse, fulfillment center, or logistics service provider. Orders containing multiple products may be delivered in multiple packages if the products are sent from different locations.
10. RIGHT OF WITHDRAWAL AND RETURN
If the distance contract relates to the sale of goods, the BUYER may exercise their right of withdrawal from the contract within 14 (fourteen) days from the date of delivery of the product to themselves or to the person or organization at the address indicated by the BUYER, without needing to provide any reason and without incurring any penalty. In the example provided by IdeaSoft, guided by iyzico, this period is set as 14 days.
To exercise the right of withdrawal, the BUYER must clearly notify the SELLER of their decision to withdraw within the 14-day period.

It is recommended that the BUYER specifies the order number and sufficient information to identify the order in their withdrawal notification.
After notifying the SELLER that they have exercised their right of withdrawal, the BUYER must return the product in accordance with the period and conditions stipulated in the current legislation.
The product to be returned must be sent together with any accessories and other complementary parts delivered with the product, if any.
If the right of withdrawal is exercised properly, the amounts collected from the BUYER and required to be refunded according to the legislation will be returned to the BUYER within the period and according to the principles specified in the current legislation.
The refund will be made, as far as possible, in accordance with the payment method used by the BUYER during the purchase, unless there is an agreement to the contrary or a legal obligation.
Important: Since Moddamarkt may work with multiple suppliers, warehouses, or fulfillment partners, the return address of the product may vary depending on the product. Therefore, before returning the product, the BUYER should contact the SELLER at moddamarkt@gmail.com to obtain the applicable return instructions and return address for the relevant order.
The sender's address on the package from which the product was sent is not always accepted as the return address.
The BUYER's statutory rights regarding defective, damaged, wrongly sent, or non-conforming products are reserved.
11. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
The right of withdrawal cannot be exercised for goods and services where it is stated in the current legislation that it cannot be exercised.
Examples of these, if the conditions in the relevant legislation are met, include;
- Products specially prepared in line with the BUYER's requests or personal needs,
- Products that are perishable or whose expiry date may pass,
- Products whose packaging, tape, seal, package, or similar protective elements have been opened after delivery and whose return is not suitable for health and hygiene reasons,
- Products that are mixed with other products after delivery and cannot be separated by their nature,
- Services performed instantly in electronic environment or intangible goods delivered instantly to the consumer if the conditions specified in the legislation are met,
- Other goods and services excluded from the scope of the right of withdrawal under the Regulation on Distance Contracts and other relevant legislation.
Any exception to the right of withdrawal applies only if the conditions stipulated in the current legislation are met.
12. DEFAULT AND LEGAL CONSEQUENCES
If the BUYER makes the payment with a credit card and fails to fulfill their payment obligations to the issuing bank or financial institution, the provisions of the credit card or financing agreement between the BUYER and the relevant bank or financial institution shall apply.
In this context, any interest, fees, and other financial obligations that may be imposed on the BUYER by the relevant bank or financial institution will be evaluated within the scope of the legal relationship between the BUYER and the relevant institution.
The BUYER accepts that they are responsible for any obligations that may arise towards the bank due to the use of a credit card.
13. AUTHORIZED BODIES
In consumer disputes arising from this Agreement, authorized Consumer Arbitration Committees and Consumer Courts can be applied to in accordance with Law on Consumer Protection No. 6502 and the current relevant legislation.
In resolving the dispute, the monetary limits, jurisdiction, and authority rules in force at the date of application shall apply.
The BUYER's rights to apply to the authorized body or courts granted to them under the current consumer legislation are reserved.
14. EFFECTIVENESS
When the BUYER creates an order via the WEBSITE and completes the payment/approval process for the order, they are deemed to have electronically accepted the applicable provisions of this Distance Sales Agreement for that order.
The BUYER acknowledges that they have been informed about the basic characteristics of the product, sales price, total payment amount, payment method, delivery conditions, SELLER information, right of withdrawal, return conditions, and other necessary preliminary information before completing the order.
This Agreement shall become effective for the relevant order upon the BUYER's electronic approval of the order.

By accepting this Agreement, the BUYER acknowledges, declares and undertakes that, upon confirming the order subject to this Agreement, the BUYER will be under an obligation to pay the price of the product(s) ordered, together with any shipping charges, taxes and other additional charges clearly disclosed before the order is completed.

ORDERING PARTY: The natural or legal person who requests goods or services through the SELLER’s Website,
PARTIES: The SELLER and the BUYER,
AGREEMENT: This Distance Sales Agreement concluded electronically between the SELLER and the BUYER,
GOODS/PRODUCTS: Movable goods subject to the purchase and other products regarded as goods under applicable legislation.
3. SUBJECT OF THE AGREEMENT
The subject of this Agreement is to determine the rights and obligations of the PARTIES in relation to the sale and delivery of the product(s) ordered electronically by the BUYER through the SELLER’s website www.moddamarkt.com, whose essential characteristics and sales price are specified on the WEBSITE and during the ordering process, in accordance with the applicable legislation, particularly Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.
The prices listed and announced on the WEBSITE are the applicable sales prices. Announced prices remain valid until they are updated or changed. Promotional or discounted prices announced for a specified period remain valid until the end of the stated period.
Before completing an order, the BUYER is informed about the essential characteristics of the product, total sales price, payment method, delivery conditions, applicable shipping charges, right of withdrawal and other required pre-contractual information.

7.1. Essential Characteristics
The essential characteristics of the goods or product(s) subject to this Agreement, including the product type, quantity, brand/model, color, size, quantity, material and other distinguishing characteristics where applicable, are displayed on the relevant product page of the SELLER’s website at www.moddamarkt.com.
Before completing an order, the BUYER may review the essential characteristics of the product(s) to be purchased on the relevant product page.
Where the SELLER conducts a promotional campaign, the characteristics, prices and applicable conditions of the products included in the campaign may be reviewed on the WEBSITE during the relevant campaign period.
Product images are intended to represent products as accurately as reasonably possible. Minor variations in color or appearance may occur due to screen settings, lighting conditions or manufacturing variations. This provision does not limit the CONSUMER’s statutory rights in relation to defective or non-conforming goods.
7.2. Prices
The prices listed and announced on the WEBSITE are the sales prices of the products.
Announced prices remain valid until they are updated or changed. Promotional prices announced for a specified period remain valid until the end of the relevant campaign period.
The product price applicable to the BUYER’s order is the sales price displayed to and accepted by the BUYER on the WEBSITE when the order is placed.
7.3. Taxes, Shipping and Payment Information
The sales price of the product(s), including applicable taxes, product quantity, discounts (if any), shipping/delivery charges and the total amount payable by the BUYER are displayed to the BUYER on the WEBSITE before completion of the order.
Order information is determined as follows:

Unit Price: Sales price displayed during the ordering process
Subtotal: Amount calculated during the ordering process
Discount: Any discount applied during the ordering process

Total: Final order amount displayed to the BUYER on the order confirmation screen
Before confirming the order, the BUYER views the total sales price and any other amounts to be charged and completes the payment accordingly.
Payment is made using one of the payment methods offered to the BUYER on the WEBSITE during checkout.
International shipments may be subject to customs duties, import taxes, VAT, customs clearance fees or similar additional charges under the laws of the destination country. Responsibility for such charges shall be determined in accordance with applicable law and the information provided to the BUYER before purchase.

9. GENERAL PROVISIONS
9.1. Information and Acceptance
The BUYER acknowledges, declares and undertakes that they have read and understood the pre-contractual information available on the SELLER’s WEBSITE concerning the essential characteristics of the product(s), sales price, payment method, delivery conditions, applicable shipping charges, right of withdrawal, return conditions and SELLER information, and that the BUYER has provided the necessary electronic confirmation.
Electronic confirmation of the order by the BUYER constitutes acceptance of this Agreement and the pre-contractual information provided before the order.
The BUYER is responsible for ensuring that the delivery, contact and billing information provided during the ordering process is accurate and complete.
9.2. Delivery Period and Delivery
The product(s) subject to this Agreement shall be delivered to the delivery address specified by the BUYER during the ordering process or to the person/entity designated by the BUYER to receive the delivery.
Each product subject to this Agreement shall be delivered within the period specified on the WEBSITE or in the pre-contractual information, taking into account the BUYER’s location, product preparation period, shipping and logistics conditions, provided that the applicable statutory maximum delivery period of 30 days is not exceeded.
Where delivery is agreed to be made to a person or organization other than the BUYER and such person or organization refuses to accept the delivery, the consequences shall be assessed in accordance with the circumstances and applicable legislation.
The SELLER may contact the BUYER where delivery cannot be completed or is delayed due to incomplete or incorrect delivery information provided by the BUYER.
If fulfillment of the product(s) ordered becomes impossible, the BUYER shall be informed in accordance with applicable legislation and any amounts collected that must be refunded shall be returned to the BUYER within the period prescribed by law.
International shipments may be dispatched from a supplier, warehouse, fulfillment center or logistics provider working with the SELLER. Where an order contains multiple products dispatched from different locations, the products may be delivered in separate packages.
10. RIGHT OF WITHDRAWAL AND RETURNS
Where this Distance Sales Agreement concerns the sale of goods, the BUYER has the right to withdraw from the Agreement within 14 (fourteen) days from the date on which the product is delivered to the BUYER or to the person or organization designated by the BUYER, without providing any reason and without paying a contractual penalty, subject to the applicable statutory exceptions.
To exercise the right of withdrawal, the BUYER must clearly notify the SELLER of the decision to withdraw within the 14-day withdrawal period.

The BUYER is advised to include the order number and sufficient information to identify the relevant order in the withdrawal notification.
After notifying the SELLER of the exercise of the right of withdrawal, the BUYER shall return the product in accordance with the periods and conditions prescribed by applicable legislation.
The returned product shall be sent together with any accessories and other complementary components delivered with the product, where applicable.
Where the right of withdrawal is validly exercised, all amounts collected from the BUYER that are required to be reimbursed under applicable legislation shall be refunded in accordance with the periods and procedures prescribed by applicable law.
Unless otherwise agreed or required by law, refunds shall, where reasonably possible, be made using the payment method used by the BUYER for the original purchase.
Important: As Moddamarkt may work with multiple suppliers, warehouses or fulfillment partners, the correct return address may vary depending on the product. Therefore, before returning a product, the BUYER must contact the SELLER at moddamarkt@gmail.com to obtain the applicable return instructions and return address for the relevant order.
The sender address displayed on the original shipping package shall not automatically be considered the applicable return address.
The BUYER’s statutory rights in relation to defective, damaged, incorrectly supplied or otherwise non-conforming products remain fully reserved.
11. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
The right of withdrawal cannot be exercised in relation to goods and services that are excluded from such right under applicable legislation.
Subject to the applicable statutory requirements, examples may include:
- Products prepared specifically in accordance with the BUYER’s requests or personal needs,
- Products that may deteriorate rapidly or whose expiration date may pass,
- Products which, after delivery, have had protective elements such as packaging, tape, seals or wrapping opened and whose return would be unsuitable for health or hygiene reasons,
- Products which, after delivery, become mixed with other products and cannot be separated due to their nature,
- Services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer where the statutory requirements for the relevant exception are satisfied,
- Other goods and services excluded from the right of withdrawal under the Distance Contracts Regulation and other applicable legislation.
Any exception to the right of withdrawal shall apply only where the requirements prescribed by applicable legislation are satisfied.
12. DEFAULT AND LEGAL CONSEQUENCES
Where the BUYER makes payment by credit card and fails to fulfill payment obligations toward the card-issuing bank or financial institution, the provisions of the credit card or financing agreement between the BUYER and the relevant bank or financial institution shall apply.
Any interest, charges or other financial liabilities that may be imposed on the BUYER by the relevant bank or financial institution shall be assessed within the legal relationship between the BUYER and that institution.
The BUYER acknowledges that they are responsible for obligations that may arise toward their bank as a result of the use of a credit card.
13. COMPETENT AUTHORITIES
For consumer disputes arising from this Agreement, applications may be made to the competent Consumer Arbitration Committees (Tüketici Hakem Heyetleri) and Consumer Courts (Tüketici Mahkemeleri) in accordance with Law No. 6502 on Consumer Protection and other applicable legislation.
The monetary thresholds, jurisdiction and competence rules in force on the date of the application shall apply to the resolution of the dispute.
The BUYER’s rights to apply to any competent authority or court available under applicable consumer protection legislation remain reserved.
14. ENTRY INTO FORCE
When the BUYER places an order through the WEBSITE and completes the relevant payment/confirmation process, the BUYER shall be deemed to have electronically accepted the provisions of this Distance Sales Agreement applicable to the order.
The BUYER acknowledges that, before completing the order, the BUYER has been informed about the essential characteristics of the product, sales price, total amount payable, payment method, delivery conditions, SELLER information, right of withdrawal, return conditions and other required pre-contractual information.
This Agreement enters into force in relation to the relevant order upon electronic confirmation of the order by the BUYER.
